Terms of Service

These Terms of Service ("Terms") govern your use of the Pakke mobile application (the "App") operated by Pakke ("we", "our", or "us"). By using the App, you agree to these Terms.

1. Service Description

Pakke is a tool that helps Canadian permanent residents track their physical presence days in Canada to estimate their eligibility for Canadian citizenship. The App provides calculations, trip tracking, and eligibility estimates based on the information you provide.

Important: Pakke is NOT a legal service and does NOT provide legal advice. The information and calculations provided by the App are estimates only. Immigration, Refugees and Citizenship Canada (IRCC) is the sole authority on citizenship eligibility. Always consult IRCC or a qualified immigration lawyer for official guidance.

2. Account Registration

To use the App, you must create an account by signing in with Apple or Google. You agree to:

• Provide accurate information
• Maintain the security of your account
• Notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account

3. Subscriptions and Purchases

Pakke offers free and premium tiers:

• Free: Physical presence calculator, manual trip logging, eligibility timeline, and CSV export
• Premium Monthly: $2.99 CAD per month — includes all free features plus AI email trip detection and background location tracking
• Premium Annual: $19.99 CAD per year — same as monthly, billed annually

Subscriptions are managed through Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your device's store settings.

4. Tip Purchases

Pakke offers optional one-time tip purchases to support development:

• Buy Me a Coffee — $1.99 CAD
• Buy Me Lunch — $4.99 CAD
• Buy Me Dinner — $9.99 CAD

Tips are non-refundable and do not provide any additional features or services.

5. Accuracy Disclaimer

While we strive to provide accurate calculations:

• Pakke's calculations are estimates based on publicly available IRCC guidelines
• Immigration law and IRCC policies may change at any time
• The accuracy of calculations depends on the accuracy of the data you provide
• AI-detected trips from email or location data may contain errors and should always be reviewed
• Pakke is not a substitute for professional legal advice
• IRCC is the final authority on all citizenship eligibility determinations

6. User Data and Content

You retain ownership of all data you provide to the App, including trip records and profile information. By using the App, you grant us a limited license to process your data solely to provide the App's services. Please see our Privacy Policy for details on how we handle your data.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Use the App to submit false information to IRCC or any government body
• Share your account credentials with others

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We are not liable for any damages arising from your use of the App, including but not limited to incorrect eligibility calculations, missed deadlines, or rejected citizenship applications
• Our total liability to you for any claims arising from your use of the App shall not exceed the amount you have paid us in the 12 months preceding the claim

9. Termination

You may delete your account at any time through the App's settings. We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your access to the App will be revoked
• Your data will be permanently deleted
• Active subscriptions should be cancelled through your device's store settings to avoid further charges

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Ontario, Canada.
